How to apply

Provisional Visas

To apply for NSW sponsorship for a provisional stage visa (163, 164, 165, 405) and for the Business Talent 132 visa you must:

  • Conduct a business research visit to NSW
  • Attend an interview with NSW
  • Complete the application forms with supporting documents
  • Pay the required application fee

To request an interview with an Assessment Officer to discuss your application, please send an email to bizmigration_interview@business.nsw.gov.au

In your request you must identify:

  • The name of the applicant
  • The name of the migration agent (if applicable)
  • The name of anyone else who will attend the interview and your relationship to them (if applicable)
  • The visa you are applying for
  • Your contact details:
    • name
    • address
    • email address
    • mobile telephone
    • telephone

Your request will be allocated to an Assessment Officer who will contact you to arrange a time for an interview.

All interviews are held at NSW Trade & Investment at:

Level 47
MLC Centre
19 Martin Place
Sydney NSW 2000.

Permanent Visas

To apply for NSW sponsorship for a permanent residence stage visa (892, 893) you must:

  • Complete the application forms with supporting documents
  • Pay the required application fee

An Assessment Officer will also contact you to arrange a visit to your business.

You must complete and sign application forms A, B, C and D. You must attach certified copies of the necessary documents listed on Form C to prove your identity and that you meet all the criteria for the visa class for which you are applying.

Please note we do not return lodged documents. If you are an existing provisional visa holder sponsored by NSW and wish to seek NSW agreement to change your proposed business activity please submit the form below with a written statement outlining the reasons for your request and with a new Business Commitment.

Applicants for the Business Owner (Residence) 892 visa must submit a complete application at least ten weeks before their provisional visa expires.

If you are considering applying for a Business Talent 132 visa you should first contact the Manager, Business Migration to discuss if you are eligible for this visa.

Application Fees

The following non-refundable application fees must be paid by bank cheque or money order payable to Industry & Investment NSW and enclosed with your application:

Provisional Visas (Sub classes 163, 164, 165, 405)
$900.00 (including GST)
Applications received from offshore applicants will be exempt from the GST component. The fees for these applications will be $820.

Permanent Residence Visas (Sub classes 892, 893, 846, 132)
$1,270.00 (including GST)

There is no application fee for a request for a change of business activity.

Processing of Applications

Processing time for successful applications is currently on average six to eight weeks. Please check this web site for updates on processing times.

Applications completed in the format requested (with fully completed Forms A to D) and with all necessary documents certified and attached will be processed more quickly.

NSW Registration for Visa Sub Classes 890 & 891

If you apply for a Business (Owner) Residence 890 or Investor (Residence) 891 visa you must register with NSW using DIAC Form 927.  NSW requires these applicants to complete NSW Form E as well as DIAC Form 927 when you apply for registration.  A copy of Form E can be downloaded here.

Migration Review Tribunal

Please note that NSW will not appeal against decisions by the Department of Immigration and Citizenship to decline granting a visa to applicants sponsored by NSW.
