I have been nominated by NSW for the Skilled Nominated visa (subclass 190) and my ability to satisfy my obligation to live and work in NSW for the first two years of my visa has been impacted by the COVID-19 outbreak.

We understand and appreciate your current situation and as such do not compel you to  move to, or remain in, NSW. You have a permanent visa which allows you to live and work across Australia. However, please be advised that NSW nominates skilled migrants in good faith they will arrive in NSW and actively contribute to our economy. NSW Business & Skilled Migration does not offer Letters of Release. All reasonable attempts should be made to live and work in NSW.

I hold a business or investor visa and my ability to satisfy residency or business activity / investment requirements has been impacted by the COVID-19 outbreak. Will my eligibility for permanent residency be affected?

The Department of Home Affairs provides key information and updates for visa holders affected by travel restrictions and the COVID-19 outbreak on their COVID-19 and The Border website.

NSW does not have additional residency requirements above what is required by the Department of Home Affairs’ for subclass 188 and 132 visas.

I am offshore and have been granted a permanent visa, can I travel to Australia?

I have to submit my visa application offshore, but am unable to leave Australia, what can I do?

If you are affected by a s48 bar, and must be offshore to lodge your visa application, NSW may re-nominate you once you are able to travel overseas; however, we cannot guarantee this. Our ability to re-nominate applicants is subject to direction from the Department of Home Affairs.

Before you travel overseas to lodge your visa application, you need to confirm with our office we are able to re-nominate you by email at skilled.migration@treasury.nsw.gov.au.
